'Precious' producer Tyler Perry is being sued by the estate of gospel singer/songwriter Bertha James, who claims the filmmaker/director illegally used an entire verse from a song she wrote in 1950 'When I Think of the Goodness of Jesus' in his 2009 film 'Madea Goes to Jail.'
According to court documents obtained by TMZ on Nov. 26, James's estate alleges that the 40 year-old black movie maverick, whose real name is Emmitt R. Perry Jr., "incorporated the entire chorus in a monologue delivered by the main character in 'Madea' referencing her deliverance from a jail sentence and leniency for repetitive criminal conduct."
The staged court proceedings were presided over by former 'Divorce Court' Judge Mablean Ephriam, who has previously appeared in Perry's 2005 debut 'Diary of a Mad Black Woman' and its follow-up 'Madea's Family Reunion,' which was released one year later.
Lionsgate Entertainment, who distributes Perry's movies, are also named in the suit, which seeks unspecified damages in excess of $75,000 for copyright infringement.
James's estate is also requesting a jury trial.

she isn't suing for the song(quote) but words she wrote in the rendition he used. Tyr reading the whole enchilada. This is why we have copywright status. Perry should've known better. I bet(75,000 dollars now he does). unquote. You can sing any song but can't claim rights without written permission from the songwriter herself/himself.

This is a phrase I have heard in the Black church/culture all my life. I have said it, and I have heard it said by many leaders and preachers in and out of the pulpit. I do not think most knew it was from a song written sixty years ago.
However I know that there must be someone employed by Mr.Perry to uncover these kinds of things...I guess they dropped the ball on this one...to bad the Bertha James estate had to go this route...
Pay up Tyler, learn and let it go...watch your back a little better next time...Much Love

How can anyone not respect a 54 year old Mother & Grandmother being a businesswoman by going to have her extensive writings & compositions protected by the existing Copyright Laws of the United States. http://www.copyright.gov/title17/
My Grandmother, Bertha Valentine James' song - "When I Think of the Goodness of JESUS" became very popular & widely sung & celebrated amongst many Christians in America a few years after it was written. [1936] So much so that many people who obviously don't have time to read their BIBLE (so busy thumping it) believe that some of the song lyrics are actual BIBLE scripture. [NOT SO]
I wonder how many of you who are here defending Tyler Perry (I am a fan of his work just as you are) have ever watched or purchased a bootleg copy of one of his plays or movies - if you have, you have violated the very same Copyright Laws that protect my Grandmother's Compositions. YOU HAVE STOLEN REVENUES FROM TYLER PERRY - he should sue you!!! Anyone who burns CDs, buys/watches/listens to bootleg Cds/DVDs is guilty of this and you should stop.
I suggest some of you educate yourselves and attempt viewing things from a broader perspective. What if it were YOUR Grandmother? You would likely feel disrespected.

The truth of the matter is this....If this very spiritual woman was inspired by GOD to pen these beautiful lyrics , then really they belong to GOD !. He said as freely as you recieve freely give .SO if God's not filing a lawsuit why should anyone else? If that line was'nt in the movie ,it would still be a good movie.!! Because when I think of the goodness of Jesus and al...oops sorry. I t just slipped out ! (wink)
